2008 Vendor / Performer Contract

Greetings, and thank you for your interest in vending / performing at this year’s 18th Annual Stonehenge Music Festival.  Stonehenge Music Society, Inc. (SMS) will again hold this year’s festival on the land of our gracious hosts, Bob, Sean and Brian Henry, on Friday, June 20 - Saturday, June 21, 2007 in beautiful Trout Run, PA.

Many of you may already be familiar with our festival, but for those who aren’t, here is more detailed information from your Festival Committee.

General Vending Information
All vendors are encouraged to arrive on THURSDAY, June 19, 2008 after 12:00 noon in order to claim your spot and set-up your stations/campsites.  Most festival-goers will arrive on Thursday evening, and live music is planned for that night.

We would appreciate each vendor /  performer donate a minimum of one (1) item from your display, booth, or CD archive into our "SMS Raffle".  These items will be collected Friday morning.

Donations of additional items are greatly appreciated and will be collected during the festival.

General Vending Rules

1         This is a family-oriented, all-weather event.  There will be no refunds for any reason.  Please come prepared for the possibility of wind, rain, hot, and/or cold temperatures.  Remember, we are in the mountains.

 

2         All vendors must comply with all Township, County, State and Federal regulations pertaining to safety, health, hygiene and fire.

 

3         No firearms, weapons, violent personages nor overtly religious themes or personalities will be permitted.  Political campaigners or activists are not accepted.  We are non-profit and non-political. Guests are not to be approached or solicited during our event.

 

4         As per local Ordinances, all food vendors cooking with electric, charcoal or gas must have a fire extinguisher (Rated 2-A: 10-B: C or better) with current inspection sticker.

 

5         Vendors must provide their own tables and chairs.  Vendors will ONLY be allowed to use the designated space for which they paid. Any vendor using space other than as per original contract will be required to either move or pay for the additional space.

 

6         Sale of any copyrighted product without lawful permission is prohibited.

 

7         Vending areas should be kept as clean as possible.  Vendors are responsible for their own trash management.  Dumpster(s) will be available at the festival grounds.

 

8         The sale of items containing tobacco (cigarettes, cigars, chew, etc.) or tobacco related products (tobacco pipes, rolling papers, etc.) are strictly forbidden at Stonehenge Music Festival.  Illegal substances, drug paraphernalia, alcohol, official SMS merchandise, or any item that may harm visitors or cause excessive litter and damage to host's property are strictly forbidden.  Prohibited items include air-horns, confetti, silly string, snap pops, and pyrotechnic and incendiary devices such as sparklers, fireworks, firecrackers, and cherry (smoke) bombs.

 

9         Glass blowing and glass blown products will be allowed; however, tobacco pipes and similar items will NOT be tolerated.

 

10     The sale of items that are of a carnival-like nature and games of chance are prohibited.

 

11     Domestic pets (DOGS, CATS, etc.) or non-domesticated animals will NOT be allowed. Local kennels will be posted and available for your pets, if you must bring them.  If you refuse, you will be asked to leave the festival grounds.  There will be NO dogs this year, NO exceptions.

 

12     Sales tax must be included on all items sold.  Collection and remittance of PA sales tax is the responsibility of each vendor.  Our suggestion is to contact the PA Dept. of Revenue; their regional office is in Scranton.  Their office number is (570) 963-4585.  Tell them specifically what you will be selling and they will determine whether you will need to obtain a license to collect sales tax. I am told that a temporary sales tax license and fee are required in Pennsylvania and are good for the length of the event, not to exceed ninety days (90) as provided for by the Pennsylvania Department of Revenue. There is no cost for the license.

 

13      Insurance, if desired, must be purchased at the vendor / performer's own expense. SMS is not responsible for any personal injuries, damage or theft of your property.


SMS will be monitoring all vending activities. If you are found selling any one of the above-listed forbidden or prohibited items, they will be confiscated pending further investigation.  Any monies paid will be forfeited, any items confiscated will be forfeited, and you will be ejected from the festival with possible legal action being taken, if warranted.

The Festival Committee reserves the right to make final interpretation of these rules.


Electric Vending Areas
Ten (10) sites are available with electric hook-ups for anyone interested in vending food, crafts or wares. Approximate size of sites are 15' x 15' and are located under the festival tent (30’ x 60’) at the top of the hill. A few sites are available along the tree line, outside the circus tent area. Vehicles may be unloaded, but must be parked at your campsite or in the large field to the right (Quiet Camping / Overflow Parking) as you enter the property from Kellyburg Road.

 

A maximum of 20 amps @ 120V will be available per site. All vendors will be responsible for providing their own lights and 100 ft. heavy-duty extension cord per circuit (20AMPS).  Cost for electric hook-up has been set at $100 per site. Please reply early to reserve your electric site.  Ticket cost(s) are NOT included as part of vendor costs. Please order your tickets through our website www.stonehengemusic.org 

 

Stonehenge Music Festival, property owners, Stonehenge Music Society, Inc. or its staff will not guarantee, nor shall they be held responsible for any electric blackout(s) which may occur during the festival.  No refunds will be issued.

Prime Vending Sites
Sixteen (16) sites without electricity will be available at the top of the hill along the edge of woods for anyone interested in vending food, crafts or wares. These are prime sites for location within earshot of both stages. Sites will be approximately 20' x 28' in size and cost $70. Please reply early to reserve your prime real estate.

Campsite Vending Sites
General vending ($20.00) may occur at your individual campsite for anyone interested in vending crafts or wares. Signs may be your best way to attract attention, with private display areas within your camp compound.

 

Tickets
Vendor fees do NOT include ticket prices for this event.  You will be responsible for both.  Tickets are available now on our website www.stonehengemusic.org

 

Advertising

Any vendor/performer who would like to advertise in our festival flyer, we would be glad to issue the following discounted rates:

 

            1 / 3 Page         $ 10.00

            1 / 2 Page         $ 20.00

            Full Page          $ 30.00

 

We would request your advertising graphics, or text information be sent to Kim Christman a/k/a “Spacewoman” at KChristman@collegium-charter.org in order to coordinate your advertising needs.

 

Flyer
A flyer for the 18th Annual Stonehenge Music Festival will be provided for each vendor, which we encourage you to display and hand-out while leading up to our event.

 

Bathrooms
Port-O-Lets will be reserved for the Electric and Prime vendors in the general vicinity.  One (1) bathroom will be reserved for performers behind the main stage.  Additional bathrooms and wash stations will be positioned throughout the festival grounds.  All bathrooms will have "tap" lights and disinfectant.

Generators
Noisy generators are not allowed on the festival grounds for any reason. "Quiet" generators are allowed in all areas on the festival grounds, including vending areas.

Menus / Photos
A copy of your menu, or photos of your wares, would be most appreciated.

Website

Ice / Water
Ice and spring water will NOT be guaranteed to be available at the festival grounds.  A general store/ beverage store is located within five miles of the festival, and they are anticipating our event
. 

 

Well-water is available on-site, behind the Cabin; approximately three-hundred (300) feet from the electric and prime vending areas.  You will be responsible for transport and storage of water, if required.  The water quality and pressure are extra-ordinary due to the property being underlain by a high-quality aquifer.

SIGNATURE PAGE

 

INDEMNIFICATION

 

Vendor/Performer agrees to indemnify fully and hold harmless Stonehenge Music Festival; property owners; Stonehenge Music Society, Inc. and their officers, employees, agents and staff; Cascade Township and Lycoming County, Pennsylvania, their officers and employees; and all sponsors of the festival; against all damage, claims, liabilities, losses, theft, injury of any kind arising from attending the festival.

Vendor/Performer also agrees to maintain a professional demeanor and agrees he/she will not perform any harmful acts to property or persons on the festival grounds or leased property.

WAIVER OF CLAIMS

The Stonehenge Music Festival; property owners; Stonehenge Music Society, Inc. and their officers, employees, agents and staff shall not be held liable for, and Vendor/Performer hereby release all claims for damage to or loss of personal property sustained by Vendor/Performer or any person claiming through Vendor/Performer resulting from fire, accident, occurrence, theft or condition in or upon the festival grounds or leased property, which they shall be part of, or adjoining areas.

 

I agree to comply with the festival rules.  I agree and understand that Stonehenge Music Festival, property owners, Stonehenge Music Society, Inc. the festival committee, their assignees, representatives, officers, employees, agents, staff, and any other sponsoring organization will not be held responsible or liable for damage or loss of product or belongings or personal liability in any connection with this festival.

Should legal assistance or legal action become necessary, Vendor/Performer agrees to pay all fees and costs incurred by the Festival.  Such action would take place in Lycoming County, Pennsylvania.
